MACT Matters

As society has evolved, negligence has become an actionable offense. In English law, individuals or legal representatives of deceased victims who have died due to another’s negligence can claim damages under tort law, in addition to pursuing criminal proceedings. The Motor Accidents Claims Tribunal (MACT), established under the Motor Vehicles Act of 1988, provides a faster remedy for accident victims.

The MACT has exclusive jurisdiction over matters related to motor accidents, removing such cases from the purview of Civil Courts. Appeals from the MACT are directed to the High Courts and must be filed within 90 days of the Tribunal’s award.

The Motor Vehicles Act, 1988, is a comprehensive piece of legislation aimed at enhancing road safety and providing compensation for loss of life or injury caused by automobile accidents. According to Section 2(30) of the Act, the “owner” of a motor vehicle is the person in whose name the vehicle is registered, or in cases involving minors or hire-purchase agreements, the guardian or person in possession under such an agreement.

Motor Accident Claims Tribunals (MACT Courts) handle claims related to loss of life, property, and injury resulting from motor accidents. Claims are filed directly with the relevant MACT, where cases are presided over by judicial officers from the Delhi Higher Judicial Service.
